Introduction
These Terms of Service ("Terms") govern your use of the website, mobile application, and related services (collectively, the "Services") operated by Rush Link Computers LLC, doing business as Rush Link Computers ("Rush Link Computers," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Services.
Acceptance of Terms
By creating an account, submitting a service request, booking a technician, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
Eligibility & Account Registration
You must be at least 18 years of age and legally able to enter into contracts to create an account and use the Services. By registering, you represent that the information you provide is accurate and complete.
Customer Accounts
Customers may create accounts to submit service requests, book technicians, manage bookings, communicate with technicians, and process payments. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Technician Accounts
Technicians may create accounts to receive service opportunities, claim jobs from the Call Queue, accept bookings, manage availability, and receive payouts. To participate as a technician, you may be required to complete verification, including background screening, and maintain an active subscription as described in these Terms.
Accurate Information
You agree to provide accurate, current, and complete information when registering and using the Services. You must update your information to keep it accurate. The provision of false, misleading, or inaccurate information may result in suspension or termination of your account.
Account Security
You are responsible for safeguarding your account credentials and for all activity conducted under your account. You agree to notify us immediately of any unauthorized use or security breach. We are not liable for losses resulting from unauthorized access if you failed to maintain adequate security of your credentials.
Technology Service Requests
Customers may submit service requests describing their technology support needs, including service type, issue description, location, and preferred scheduling. Service requests submitted through the platform may be made available to eligible technicians through the Call Queue. We do not guarantee that a technician will be available or will claim any particular service request.
Technician Marketplace & Assignment
Rush Link Computers operates a marketplace that connects customers with technicians. We may facilitate matching based on service type, location, and availability, but we do not guarantee the availability, quality, or suitability of any particular technician. The relationship for the performance of services is between the customer and the technician; Rush Link Computers provides the technology platform and related services.
Bookings and Scheduling
Customers may book technicians for scheduled services based on available time slots. Bookings are subject to technician availability and confirmation. Once a booking is confirmed, the customer and technician are expected to adhere to the agreed-upon date, time, and location. Rescheduling or cancellations may be subject to the policies described in these Terms.
Quotes and Estimates
For certain project-based services, an admin-prepared quote may be required. In such cases, Rush Link Computers will prepare a quote with an approved final amount, which the customer must approve before payment is processed. Hourly services are billed based on the technician's hourly rate and the duration of service. Estimates provided through the platform are approximate and may differ from the final amount.
Pricing
Pricing for services may be based on hourly rates or project-based quotes, depending on the service type. Applicable pricing is displayed through the platform at the time of booking or quote approval. Rush Link Computers may adjust pricing from time to time. Changes to pricing do not affect bookings or quotes already confirmed.
Payments
Payments for bookings and services are processed through third-party payment processors such as Stripe. By making a payment, you agree to the terms and conditions of the applicable payment processor. Payment is typically collected at the time of checkout or upon customer approval of a project quote. We do not store full payment card numbers; payment card information is handled by the payment processor.
Refunds and Cancellations
Cancellation and refund eligibility depends on the status of the booking and the timing of the cancellation. Bookings may be cancelled through the platform or by contacting us. A cancellation fee may apply in certain circumstances, such as late cancellations. Refunds, where applicable, are processed through the original payment method and may take time to appear on your account statement, depending on your payment processor or bank. Specific cancellation and refund outcomes are determined based on the circumstances of each case and applicable platform policies.
Technician Earnings and Payouts
Technicians earn a share of the revenue from completed jobs, with Rush Link Computers retaining a platform fee. Earnings are calculated when a job is marked complete and may be paid out through Stripe Connect transfers to the technician's linked account. Technicians are responsible for completing any required onboarding with the payment processor to receive payouts. Payout timing and availability depend on the payment processor's processing schedule and the technician's account status.
Call Queue
The Call Queue is a feature that displays available service requests and, where applicable, live inbound calls to eligible technicians. Jobs in the Call Queue may be claimed on a first-come, first-served basis by eligible technicians. Rush Link Computers does not guarantee that any particular job or call will remain available or that a claim will be successful.
TAKE CALL
The TAKE CALL feature allows an eligible, on-duty technician to claim a live inbound customer call. When a technician takes a call, the call may be routed to the technician's verified mobile phone number. Only technicians with verified mobile numbers and active authenticated device sessions are eligible for TAKE CALL. Rush Link Computers does not guarantee that call routing will always succeed or that a claimed call will be connected.
Telephone Communications
Telephone communications, including inbound calls to our service hotline and call routing to technicians, may be handled through third-party telephony providers such as RingCentral. Call metadata, including caller numbers and call timing, may be processed by these providers as necessary to provide the service. Caller numbers are masked in public-facing interfaces and are only visible to authorized users within the platform.
Availability of Technicians
Technician availability is indicated by the technician and may change at any time. Rush Link Computers does not guarantee that any technician will be available at a particular time or for a particular service. Technicians may set their availability status and manage their schedules through the platform.
Acceptable Use
You agree to use the Services only for lawful purposes. You agree not to:
- Violate any applicable law, rule, or regulation.
- Infringe the rights of any other person or entity.
- Submit false, misleading, or inaccurate information.
- Interfere with or disrupt the Services or servers.
- Attempt to gain unauthorized access to any part of the Services.
- Use the Services to transmit unsolicited communications or spam.
- Reverse engineer, decompile, or disassemble any part of the platform.
- Use the Services in any manner that could damage, disable, or impair the platform.
Prohibited Conduct
Prohibited conduct includes, without limitation, fraud, harassment, discrimination, threats, transmitting malware, circumventing payment or fee structures, creating accounts under false pretenses, and any conduct that could harm Rush Link Computers, its users, or third parties. We may suspend or terminate accounts engaged in prohibited conduct.
Intellectual Property
The Services, including the Rush Link Computers name, logo, content, software, and design, are owned by Rush Link Computers or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services without our prior written consent. Content you submit remains your property; by submitting it, you grant us a license to use it as necessary to operate the Services.
Third-Party Services
The Services may integrate with or rely on third-party services, including payment processors (such as Stripe) and telephony providers (such as RingCentral). We are not responsible for the practices or performance of these third parties. Your use of third-party services is subject to their respective terms and policies.
Platform Availability
We strive to maintain the availability of the Services but do not guarantee that they will be uninterrupted, error-free, or available at all times. We may modify, suspend, or discontinue the Services or any part of them at any time without notice. We are not liable for any interruption or unavailability of the Services.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RUSH LINK COMPUTERS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RUSH LINK COMPUTERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO RUSH LINK COMPUTERS THROUGH THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR, IF GREATER, ONE HUNDRED U.S. DOLLARS ($100).
Indemnification
You agree to indemnify and hold harmless Rush Link Computers and its affiliates, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice, if we believe you have violated these Terms, applicable law, or the rights of others. You may stop using the Services at any time. Upon termination, all licenses granted to you under these Terms will cease immediately.
Changes to These Terms
We may update these Terms periodically. When we do, we will update the "Last Updated" date shown at the top of this page. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the state and federal courts located in Philadelphia, Pennsylvania, for any disputes arising from these Terms or the Services.
SMS / Text Messaging Terms
By opting in to Rush Link Computers SMS/Text notifications, you consent to receive operational and service-related text messages at the mobile number you provided. For technician dispatch alerts, messages may include:
- New customer call notifications
- New service or job opportunities
- Scheduling and service notifications
- Account or service alerts
Message frequency varies. Message and data rates may apply. Consent to SMS messaging is not a condition of purchasing Rush Link Computers services unless otherwise specifically disclosed.
Reply STOP to unsubscribe where supported. Reply HELP for assistance where supported. You may also manage available notification preferences through your Rush Link Computers account.
Carriers are not responsible for delayed or undelivered messages. Rush Link Computers does not guarantee the delivery of any particular message. Rush Link Computers may change or discontinue the SMS program subject to applicable requirements. SMS consent is not used for unrelated third-party marketing.
Note: SMS/text messaging may not yet be active for all users. The terms in this section apply once the SMS feature is enabled for your account.
